DB Hockey Waiver and Liability Releasec

PLEASE READ CAREFULLY BEFORE SIGNING. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

This Waiver and Liability Release Agreement ("Agreement") is entered into between the undersigned participant (hereinafter referred to as “Participant”), and DB Hockey Inc., its owners, coaches, employees, agents, affiliates, and volunteers (collectively referred to as “DB Hockey”).

By signing this document electronically via the DB Hockey e-Signature Plugin on https://dbhockey.ca, the Participant acknowledges and agrees to the following terms:

1. Assumption of Risk

I am fully aware that participation in ice hockey and any related activities (training, games, clinics, practices, and use of facilities) involves inherent risks, including but not limited to: falls, collisions, contact with other players, puck or stick impact, ice conditions, equipment failure, and other unforeseen dangers.
I voluntarily choose to participate in these activities, understanding the potential for injury, disability, or death, and I accept full responsibility for all such risks.

2. Release and Waiver of Liability

In consideration of being allowed to participate in DB Hockey activities, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release and forever discharge DB Hockey Inc., its directors, officers, employees, coaches, agents, and volunteers from any and all liability, claims, demands, actions, or causes of action arising out of any damage, loss, injury, or death that may result from my participation, whether caused by negligence or otherwise.

3. Indemnification

I agree to indemnify, defend, and hold harmless DB Hockey from and against any and all claims, damages, losses, liabilities, or expenses (including reasonable attorney’s fees) arising out of or related to my participation in DB Hockey activities or breach of this Agreement.

4. Medical Treatment

I consent to receive any emergency medical treatment deemed necessary during participation. I understand that I am solely responsible for any medical or insurance costs resulting from such treatment.

5. Personal Health and Fitness

I affirm that I am physically fit and capable of participating in hockey activities. I have not been advised by a qualified medical professional to refrain from such activities.

6. Media Release

I grant DB Hockey permission to use my name, likeness, image, and voice in photographs, videos, or other media for promotional and marketing purposes, without compensation or further consent.

7. Electronic Signature Consent

By signing electronically through the DB Hockey e-Signature system on https://dbhockey.ca, I acknowledge that my digital signature carries the same legal validity and enforceability as a handwritten signature under applicable electronic signature laws in Canada.

8. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts located in Ontario, Canada.

9. Acknowledgment of Understanding

I have read this Waiver and Release in its entirety and fully understand its terms. I acknowledge that I am signing it freely and voluntarily, and that by signing it I am giving up substantial legal rights, including the right to sue DB Hockey for any injuries or damages I may sustain.
